This privacy policy provides you with all the necessary information on how, to what extent and for what purpose TCG Informatik AG (TCG Process) or third-party providers collect personal data from you and use it. "Personal data” is information about a specific or identifiable person. Your data will be collected and used in accordance with the provisions of the Swiss Data Protection Act, the Data Protection Ordinance, the Telecommunications Act and the provisions of the European General Data Protection Regulation (GDPR) as well as other provisions of Swiss and European data protection law.

What information do we collect?

 

Information for providing our products and services

We provide various products and services (e.g., technical support and professional services) with different methods of delivery. Some may be used as an on-premises or cloud solution. Some of the products can be used on mobile device only.

In general, when you use our products and services, you may send us information that may contain personal data such as name, e-mail address, etc. It is your responsibility to decide which information you want to send us and process via our products and services. Below, you can find more information on data collection in our products and services:

On-premise products

TCG Process does not have access to any of the data in the documents that you process in our on-premise products. For example, when you digitize, convert, or recognize any document by using DocProStar, TCG Process does not have access to any data in such document. TCG Process may only receive aggregate data about product usage (e.g., statistics) for billing, analytical, and fraud prevention purposes.

Mobile products

“TCG Process DocSnap allows mobile users to capture and transmit images of documents to a target DocProStar environment. The application itself does not ask for any personal information and TCG Process does not have access to any of the data in the documents that you process in the app DocSnap. Based on the configuration defined in the target DocProStar environment by our customer using the application, the app may ask the user to enter personal data like e-mail address, date of birth etc. Since TCG Process does not have access to such data we advise you to consult the privacy policy of the customer who configurated the application DocSnap for further information.

Webinars, Support and request information

If you join one of our hosted webinars, we process contact data and the additional personal data you have provided to us. You send us information that may contain personal data, such as your identity or contact info, when you request our help with one of our products/services, or to receive information about TCG Process and/or our products/services.

Information that TCG Process receives from your use of our products and websites

We collect information about our products and websites that you use and how you use them.

  • Local storage

We may collect and store information on your device using local storage of your browser or application.

  • Device information

We collect information about your device (such as type and version of your browser and operating system, type and model of your device, and unique identifiers about your device). We may associate your identifiers with your other information that we have collected.

  • Log information

When you use our products, visit our websites, or review the information we send you, we automatically collect and store certain information in server logs. This may include:

  • Information on how you used our products and websites
  • Internet Protocol (IP) address
  • Technical information about your device
  • Cookies that may uniquely identify your browser or your product account

 

  • Location information

We use your IP address and the other log information to help us understand which language to use for you and for statistical purposes to improve our products and websites.

Information that TCG Process receives from third parties

 

  • TCG Process may receive personal data such as contact, financial, and transaction data about you from our product resellers, or marketing partners if and in so far as allowed by applicable law.
  • For some products and services, including social networks, we receive and store sign-in information, as well as other information that you allow us to receive when you connect our product and services with social networks.
  • We may further receive technical data from analytics providers such as Google.

Our legal basis for collecting and using the personal data described in this privacy policy depends on the personal data we collect and the specific purposes for which we collect it.

Consent: We may rely on your freely given consent at the time you provided your personal data.

  • To provide you with news and information about our services.
  • To perform marketing research and for marketing purposes.

Contract: To perform our contractual obligations or take steps linked to a contract with you.

  • To establish and fulfil a contract with you, for example if you make a purchase from us or download an application. This may include verifying your identity, taking payments, communicating with you, providing customer services and arranging the delivery or other provision of products or services;

    • we will use your personal data to provide services you have requested, and respond to any comments or complaints you may send us;

    • we may monitor any customer account to prevent, investigate and/or report fraud, terrorism, misrepresentation, security incidents or crime, in accordance with applicable law;

  • For compliance with applicable laws and protection of our legitimate business interests and legal rights, including, but not limited to, use in connection with legal claims, compliance, regulatory, investigative purposes (including disclosure of such information in connection with legal process or litigation).

Who will we share your data with and where do we transfer the personal data?

If necessary to perform a service you request from us, to execute an order you have placed or to follow-up on your enquiries, we will share your information with other TCG Process entities or third party service providers, for example email and hosting providers, suppliers and delivery services.

We may transfer personal data to locations outside of the jurisdiction in which we provide our services to you. We may process your data within Switzerland and the EU/EEA as well as the United States. For example, we currently collaborate with marketing service provider who are headquartered in the United States. If and to the extent your personal data is transferred to and/or stored at a destination outside of Switzerland/EU/EEA, we will take all steps reasonably necessary to ensure that your data is treated securely. To the extent that these countries are outside the EEA and the EU has not adopted an adequacy decision for these countries, we have made appropriate arrangements to ensure an adequate level of data protection for any data transfers. These include, for example, the EU’s standard contractual clauses. In these cases, however, it is possible and there is a risk that authorities in the respective third country (e.g., intelligence services) may gain access to the transferred data and that the enforcement of your data subject rights cannot be guaranteed. When obtaining your consent via the consent banner, you will also be informed about this.

Data Security

We are committed to ensuring that your information is secure. In order to prevent unauthorized access or disclosure, we have put in place technical and organisational measures to safeguard and secure the information we process from you. We ensure a high level of security for particularly confidential data, for example with regard to your inquiries to us, by using SSL encryption. However, we would like to take this opportunity to point out the general dangers of Internet use over which we have no control.

How long do we store your data?

We retain information about you only for as long as we need it for the purposes for which it was collected. After that time your personal data will be erased (unless we have the statutory right or obligation to further keep this data).

Information, Deletion, Blocking

You can obtain information free of charge at any time about the personal data we have stored about you and about the origin, recipient and purpose of data collection and data processing. You also have the right to demand the correction, blocking or deletion of your data. Excluded from this is data that is kept due to legal regulations or is required for proper business processing. If data is not covered by a legal archiving obligation, we will delete your data at your request. If the archiving obligation applies, we will block your data. Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke an already given consent at any time. Analysis tool Matomo

We use "Matomo" (formerly "Piwik"), an open-source project of InnoCraft Ltd. as a web analytics service on our website. The operator InnoCraft Ltd. is located at 150 Willis St, 6011 Wellington, New Zealand (hereinafter referred to as: "InnoCraft"). Matomo uses cookies, which are small text files that are stored on your terminal device and enable an analysis of your use of our website. For this analysis, the cookies are stored on your computer. The information collected in this way is stored exclusively on our server. Our website uses Matomo with the extension "AnonymizeIP". This means that IP addresses are processed in abbreviated form, so that a direct link to your person and your personal data can be excluded. The IP address transmitted by your browser via Matomo is not merged with other data collected by us.

We use Matomo for the purpose of analyzing the use of our website and thereby improving individual functions and the user experience. The statistical evaluation of user behavior enables us to continuously improve our website and better design it for you as a user. Web fonts from Adobe typekit

Our website uses so-called web fonts provided by Adobe Typekit for the uniform display of fonts. When you access a page, your browser loads the required web fonts into your browser cache in order to display text and fonts correctly. For this purpose, the browser you are using must connect to Adobe Typekit's servers. This enables Adobe Typekit to know that your IP address has been used to access our website. Google maps plugin

We use a plugin of the internet service Google Maps on our website. The operator of Google Maps is Google Inc, located in the USA, CA 94043, 1600 Amphitheatre Parkway, Mountain View. By using Google Maps on our website, information about the use of this website and your IP address is transmitted to a Google server in the USA and also stored on this server. We have no knowledge about the exact content of the transmitted data, nor about their use by Google. In this context, the company denies the connection of the data with information from other Google services and the collection of personal data. However, Google may transmit the information to third parties. If you disable Javascript in your browser, you prevent Google Maps from running. However, you will then also not be able to use any map display on our website. By using our website, you consent to the described collection and processing of information by Google Inc.
